The group of gamers attempting to block Microsoft's proposed acquisition of Activision Blizzard has amended and once again filed their lawsuit against the tech giant.
The group of gamers seeking to prevent Microsoft's proposed acquisition of Activision Blizzard have modified and re-submitted their lawsuit against the Xbox maker.
The gamers originally filed a private antitrust lawsuit in December last year arguing that the company's proposed deal with Activision would lead to an excessive amount of control in the market, exclusion of competitors, limited product releases, reduced options for consumers, and increased prices.
However, in late March, it became known that the judge dismissed the lawsuit stating that there is no proof to support the claim that the acquisition would harm competition in the market. Additionally, the judge found it impractical for Microsoft to make Call of Duty exclusive.
As reported by Reuters, the plaintiffs were given a 20-day period to revise their lawsuit and file it again, and they have now completed this process.
The updated 73-page lawsuit now includes redacted information that, according to the plaintiffs, originated from Microsoft's internal documents, including a strategic memo. Additionally, there are redacted portions that disclose specifics of the ten-year arrangement that Microsoft proposed to Sony to ensure that Activision games continue to be available on PlayStation.
Lawyers representing the group have issued subpoenas for additional information to companies such as Activision, Nintendo of America, Sony, and others.
Microsoft's lawyers stated in a court filing last week that the initial case of the group of gamers was based mainly on "flawed legal arguments based on outdated Supreme Court cases", as per Reuters. In addition, they stated that the plaintiffs "waited 11 months after the transaction was announced to file their lawsuit, and then wasted several additional months filing an implausible complaint."
