Nexon has filed a lawsuit against Ironmace, the developer behind the upcoming multiplayer dungeon crawler Dark and Darker, for "copyright infringement". The publisher now wants a jury trial.
In case you missed it, Nexon accused Ironmace developers of stealing and using assets from its unreleased game known as P3. The police conducted a search of the developer's office and reportedly confiscated the materials. Ironmace denies the accusations, but Dark and Darker has still been taken down from Steam. Find out more about the story in our article.
In the lawsuit (via Eurogamer), Nexon says its former employees that are now working at Ironmace signed a "one-year-non-compete clause" as part of their Employee Agreement. This clause "prevents employees from working in the same line of business that could potentially infringe on Nexon's trade secrets, without Nexon's prior consent".
Nexon also provided images of P3 and Dark and Darker, which are supposed to prove that Ironmace copied some in-game actions, such as characters "[moving] their hands in a distinctive circular motion over chests without physically touching the chest" to open these chests. There are many side-by-side pictures from both games that show similarities between the characters and design decisions. You can find more from this video by Onepeg:
Nexon wants Ironmace to stop the development of Dark and Darker and pay for damages and the lawsuit expenses.
