Genki, in their turn, said they didn't sign any NDAs.

Nintendo's lawyers allegedly confronted Genki, who had shown an unofficial prototype of Nintendo Switch 2 at CES 2025.
At the Consumer Electronics Show in Las Vegas at the beginning of January, Genki, an accessory manufacturer, demonstrated a replica of Nintendo's console Switch 2. The showcased device was created based on details about the Switch successor that were available online, as Genki shared in an interview with Game*Spark (via Automaton).
In response, in an interview with CNET (via Automaton), Nintendo publicly clarified that "the gaming hardware that Genki presented as Nintendo hardware at CES is unofficial and was not provided to the company by us." Also, Nintendo told Sankei Shimbun that the images and videos referring to Switch 2 that have been circulating recently "are not official."
Apart from this, Nintendo reportedly decided to take legal action against the accessory manufacturer. French journalist Julien Tellouck shared the details, saying that Genki representatives told him Nintendo's lawyers contacted the company. However, the accessory manufacturer denies any misconduct as they never signed any NDAs with Nintendo.
"I spoke with the guy from Genki, just behind me," Tellouck said (via The Game Post). "He told me that Nintendo had already sent lawyers their way. But Genki has nothing to worry about because they've never signed any papers with Nintendo, no confidentiality agreement, no NDA. So, the Japanese brand is in the clear."
