
Nintendo has won a legal battle against 1fichier.com, a French file storage site operated by Dstorage SAS that handles pirated copies of Nintendo games.
The lawsuit can be traced back to 2021 when Dstorage was ordered by the Judicial Court of Paris to pay €442,750 in compensation and €27,000 in legal fees to Nintendo, as it refused to remove or block access to pirated Nintendo games after being contacted by the gaming giant. Dstorage decided to launch an appeal against the ruling, which failed in April 2023 as the Paris Court of Appeals sided with Nintendo.
Now, they lost the final appeal, as The Cour de Cassation, France's highest court, has confirmed Dstorage SAS liable for distributing the content illegally. Therefore, the French site will need to comply with Nintendo's demands to remove unauthorized copies of their games as soon as possible.
Nintendo has shown satisfaction with the court's decision and issued a statement (via VGC) saying that it "believes that it is significant not only for Nintendo but for the entire games industry."
"It will prevent sharehosters like 1fichier.com from claiming like it did during the proceedings on the merits that a prior decision from a court is needed before pirated content must be taken down, and it confirms the rights that holders have to give notice of when claiming that notified content infringes copyright or trademark rights."
Nintendo has been very active in protecting its games and IPs by taking advantage of legal methods. In 2024 alone, it had sued streamer Jesse "EveryGameGuru" Keighin, for live streaming unreleased Switch games, Palworld developer Pocketpair over alleged patent infringement, as well as the developers of the Yuzu emulator, an open-source Nintendo Switch emulator.
