On the other side, Apple is not giving up yet; it is asking the court to pause the ruling temporarily.

Although Apple has asked a federal appeals court to temporarily pause key provisions of a U.S. judge's order requiring the company to open its App Store to more competition, Epic Games is still aiming to bring back Fortnite to iPhones and iPads in the US this week.
According to Reuters, in a filing to the 9th U.S. Circuit Court of Appeals, Apple said that the new ruling would block the company from "exercising control over core aspects of its business operations. " Therefore, if the order is not suspended while their legal challenge is pending, the company would be "irreparably harmed."
Epic Games said that Apple's Motion to Stay is a "last ditch effort to block competition and extract massive junk fees at the expense of consumers and developers."
Epic Games continued, saying that since the court decision was issued, developers have introduced better payment methods, deals, and consumer choices by updating their apps, which resulted in Apple being faced with "a surge of genuine competition," although those approaches benefit US consumers.
The developer has expressed their strong determination to bring back Fortnite, which was taken down from the App Store in 2020, to iOS device users this week.
Meanwhile, Epic's CEO Tim Sweeney has shared the timing of Apple's injunction stay request, explaining that "The injunction remains in effect until the 9th Circuit Court rules, which will happen sometime after the May 26 filing."
