Stability AI & Midjourney Are Being Sued For Copyright Violations

The class-action lawsuit filed by three artists alleges that Sta­ble Dif­fu­sion has been trained on stolen intellectual property.

The ongoing confrontation between Digital Artists and AI continues with three artists launching a class-action lawsuit against Stability AI, the developers of Stable Diffusion, Midjourney, and a portfolio platform DeviantArt, which recently released DreamUp, a paid app built around Sta­ble Dif­fu­sion. The suit alleges that the AI generators in question have been trained on stolen intellectual property and violated copyright laws on multiple occasions by using the artists' works without their consent.

The suit, filed by lawyer Matthew Butterick, has been brought forward by artists Karla Ortiz, Kelly McKernan, and Sarah Andersen, who claim that generative AIs affected "thou­sands – pos­si­bly mil­lions – of fel­low artists".

According to a lengthy blog post shared by Butterick, the plaintiffs act on behalf of creators "con­cerned about AI sys­tems being trained on vast amounts of copy­righted work with no con­sent and no credit".

    I don't think they're going to win this,

    The wind is blowing in the direction of easing copyright protections when it comes to data mining and AI research.

    The EU adopted a directive (DSM) in 2019 which would allow research institutes to use copyrighted works in their machine learning,

    and the UK is implementing their own exception to copyright in the name of AI research.

    What a joke. AI doesn't steal art anymore than an artist using reference does.

    They're just a bunch of sad artists who are upset that anyone can generate art and they don't own power anymore.

    It is good to hear that they have been sued. This is the biggest art heist in history and is ruthlessly aimed at destroying millions of jobs so a few companies can get rich off it. Sure there are constructive uses for AI, but the collateral damage is a thousand times greater and the companies show no ambition to protect the creators and future artists.
