Getty Images Sues Stable Diffusion Developer

The company accuses Stability AI of infringing its intellectual property rights.

Just yesterday, we reported on the case of three artists filing a class-action lawsuit against Stability AI, Midjourney, and DeviantArt, related to the alleged copyright infringements. Over the past 24 hours, yet another company announced that they are launching legal proceedings against Stability AI, the developer of Stable Diffusion, starting a new trend in the ongoing battle of creators vs. generative AIs.

This time, the plaintiff is the well-known image library Getty Images, which recently shared a short statement claiming that the developers of SD infringed its intellectual property rights by unlawfully using its materials to train the AI. According to the statement, Getty Images' position is that Stability AI "unlawfully copied and processed millions of images protected by copyright and the associated metadata owned or represented by Getty Images".

"Getty Images believes artificial intelligence has the potential to stimulate creative endeavors. Accordingly, Getty Images provided licenses to leading technology innovators for purposes related to training artificial intelligence systems in a manner that respects personal and intellectual property rights," reads the statement. "Stability AI did not seek any such license from Getty Images and instead, we believe, chose to ignore viable licensing options and long‑standing legal protections in pursuit of their stand‑alone commercial interests."
