The journal states that the plan to launch the next-generation console was discussed during a meeting that took place in May 2022. More than ten executives were present at the meeting, including Microsoft CEO Satya Nadella and Xbox Head Phil Spencer.
This is not the first time that 2028 has been mentioned as the year for next-gen consoles as lawyers have repeatedly pointed to this release window. Please note that these are not 100% plans as Microsoft has not made any specific statements regarding this.

The legal documents also revealed that Bethesda's long-awaited The Elder Scrolls VI shouldn't be expected until 2026. The game will be released on PC and Xbox only, Microsoft has confirmed. Learn more here.
