Nintendo Claims Mods Don't Count as Games in Lawsuit Battle Against Palworld

The company knows how to twist the case.

Nintendo's legal fight against Palworld's developer Pocketpair continues, and the Japanese company refuses to give up even an inch. 

Previously on Nintendo VS Pocketpair: Nintendo keeps acquiring patents to target the studio, accusing it of "stealing" mechanics like ball throwing, "smooth switching or riding objects," and summoning characters to fight for you – the most outrageous of them all. It's "an embarrassing failure of the US patent system," according to an IP attorney, and it's hard to disagree. 

Now, Pocketpair strikes back, arguing that mods, like the Pokémon one for Dark Souls 3, are prior art that could invalidate Nintendo's patent claims. However, the Japanese company refuses to recognize them as such, according to Game Fray, because mods are not standalones, they require a game to run.

Many game creators look to mods for inspiration, so Pocketpair's defense makes sense and could help it win, as Japanese courts often side with patent lawsuit defendants who present examples of prior art.

Hopefully, Palworld will find means against Nintendo, as its massive patent deals are getting out of hand, threatening the whole industry with unreasonable lawsuits.
