Getty Images Sues Stable Diffusion Developers Again

The photo library is accusing the AI tool creators of stealing 12 million images from its database.

Getty Images has filed a lawsuit in the US against Stability AI, the creator of the popular AI art generator Stable Diffusion. The company behind the photo library is accusing Stability AI of "brazen infringement of Getty Images’ intellectual property on a staggering scale."

As noted by The Verge, it says that Stability AI has stolen over 12 million images from its database "without permission ... or compensation ... as part of its efforts to build a competing business" and infringed on Getty Images' copyright and trademark protections. While the first one is clear, the trademark claim addresses the AI-generated images that have Getty Images' watermark on them:

“We can confirm on Friday Getty Images filed a complaint against Stability AI, Inc. in the United States District Court in Delaware,” Anne Flanagan, vice president of communications at Getty Images, told The Verge. “Getty Images has also filed a Claim in the High Court, which has not been served at this time. As is customary in the UK, on January 16 Getty Images sent and requested a response to a letter before action from Stability AI Limited within a customary timeframe. Stability AI Limited have confirmed receipt of this letter.”

According to copyright lawyer Aaron Moss, the case will be slow to move forward, so we probably won't see the outcome of the human vs. AI battle soon.

Getty Images announced the start of its legal war with Stability AI last month, saying that it has "commenced legal proceedings in the High Court of Justice in London". unsurprisingly, the case takes a universal turn.

This is not the only legal fight for Stability AI, it is also getting sued together with Midjourney and DeviantArt by three artists for violating copyright laws.
