A Tattoo Artist Loses Case Against Take-Two Regarding Copyright Infringement

The artist also has an ongoing lawsuit involving his work in NBA 2K21 on players Danny Green and Tristan Thompson.

In 2017, tattoo artist Jimmy Hayden filed a lawsuit against Take-Two, the publisher behind the beloved GTA franchise and others, alleging the unauthorized use of his work. The dispute centered around images inked on LeBron James' body, replicated in the NBA 2K series with the virtual depiction of the basketball star.

However, on April 19, the court ruled in favor of the defendant, affirming their rights to represent the athlete.

"The decision is an important decision for the entertainment industry. It is also an important decision for anyone who has ever gotten a  tattoo and might have otherwise worried about their freedom to share their bodies with their tattoos. And it is a good development for tattoo artists as a contrary verdict could have discouraged people from getting tattoos at a time when the art form is flourishing," stated the Take-Two representative Dale Cendali (via PC Gamer).

Take-Two's lawyer highlighted the significance of this decision for the industry, as the digital portrayal of famous figures is a common practice in modern games. This ruling provides stability for developers regarding the depiction of real-world people.

Notably, tattoo artists have pursued similar legal actions in the past, with instances like the case involving UFC Undisputed 3 and tattoo artist Chris Escobedo, who successfully sued THQ for $22.5 thousand in 2013.
